ბავშვის საუკეთესო ინტერესების რეალიზების მექანიზმები მედიაციაში

სტატიაში შესწავლილია რამდენად ეფექტიანად რეალიზდება ბავშვის საუკეთესო ინტერესების პრინციპი მედიაციის პროცესში და რამდენად უზრუნველყოფს არსებული სამართლებრივი და პრაქტიკული მექანიზმები ამ პრინციპის რეალურ განხორციელებას. განხილულია ის ინსტრუმენტები და პროცედურული გარანტიები, რომელთა საშუალებითაც შესაძლებელია ბავშვის ინტერესების დაცვა, აგრეთვე შეფასებულია მათი ეფექტიანობა როგორც თეორიულ, ისე პრაქტიკულ ჭრილში.
განსაკუთრებული ყურადღება ეთმობა მედიატორის, მედიაციის მხარეებისა და მათი წარმომადგენლების როლს ბავშვის საუკეთესო ინტერესების უზრუნველყოფის პროცესში. გაანალიზებულია მედიატორის პროფესიული კომპეტენციის, მიუკერძოებლობისა და ბავშვის მიმართ მგრძნობიარე მიდგომის მნიშვნელობა, ასევე მხარეთა პასუხისმგებლობა, რომ პროცესში არ დაირღვეს ბავშვის უფლებები და ინტერესები.
სტატია ასევე იკვლევს ბავშვის მოსმენისა და მედიაციაში მონაწილეობის უფლებასთან დაკავშირებულ სამართლებრივ და პრაქტიკულ გამოწვევებს. მათ შორის განხილულია ბავშვის მედიაციის სესიაზე მოწვევის საკითხი და ამასთან დაკავშირებული რისკები, ასაკობრივი ზღვრის დადგენის პრობლემატიკა, ბავშვის მონაწილეობის ნებაყოფლობითობის უზრუნველყოფა, მშობლების გავლენა ბავშვის პოზიციის ფორმირებაზე და მედიატორის კომპეტენცია, უზრუნველყოს ბავშვის აზრის თავისუფალი და დაცული გამოხატვა. აღნიშნული საკითხების ანალიზი მიზნად ისახავს იმ გარემოებების იდენტიფიცირებას, რომლებიც ხელს უწყობს ან აფერხებს ბავშვის საუკეთესო ინტერესების ეფექტიან დაცვას მედიაციის ფარგლებში.
